According to the Chief Magistrate, Shuaibu Usman, since the counsel to the State Security Services, (SSS), through its lawyer, Moses Idakwo had filed for a discontinuation of the case, he had no option than to discharge the accused.

“The accused person is hereby discharged and the case struck out,” Usman said.

The federal government through its agent, SSS, had elected to withdraw the case at the lower court for a higher court, which has jurisdiction to entertain charges bordering on terrorism, to take over.

Although he has been discharged by the magistrate court, Mr. Kanu may have a few more steps to freedom as he is also being tried at a Federal High Court.

However, Kanu will be filing for bail via his lawyer, Vincent Obetta, on Thursday, December 17, as Justice of the Federal High Court, Abuja, Adeniyi Ademola, is expected to rule on the bail application.

Mr. Kanu had been in detention at the SSS cell since his arrest on Saturday, October 17, by the secret service operatives.

Since his arrest, wave of protests, engineered by IPOB, as well as members of the Movement for the Actualization of Sovereign State of Biafra (MASSOB) had swept through the South-East and parts of the South-South, demanding his immediate release.
